When you visit the hospital for a procedure, you certainly do not want anything to go wrong. But whether you want to think about it or not, there are, of course, times when things do go wrong. When this happens, one of the things that comes to mind is the possibility of suing for negligence or for malpractice. The statute of limitations essentially sets a limit on how long a person is allowed before their suit is no longer deemed valid. The specifics of the statute of limitations vary from state to state, and if you are thinking about filing suit yourself you will want to take the time to learn and understand the specifics in place in the state where your procedure took place.
The basic foundation of the statute of limitations is the limit on how long you can wait before filing suit for malpractice. The amount of time allowed for suit can be anywhere from a couple years to a number of years, and there can be circumstances that can stretch this time even longer. But the basic statute of limitations applies in all those cases wherein the negative effects or repercussions of a surgery, operation, or some sort of negligence are discovered immediately. The statute of limitations begins immediately in these cases, and generally the person will have between two and four years to file suit. Delayed identification of negative effects is one of the major extenuating circumstances that can extend the statute of limitations. Perhaps the negative effects do not evidence themselves until a couple years after the date when the ommission, negligence, or mistake originally took place. This is why states allow for the statute of limitations to begin late – in this instance, it begins when the negative effects are discovered. Finally, states also impose an abolute cap, which sets a number of years after which suit can no longer be filed, even in those instances where the problem is discovered late. For instance, the cap in Massachusetts is seven years, so even if someone discovers a problem that was directly related to a surgery that took place eight years earlier, they can no longer file suit, no matter how blatant the ommission or act of negligence might have been. In Florida, this time is much shorter – being placed at four years. If you are in the unfortunate position of needing to file a malpractice suit, know the statute of limitations in your state, and act accordingly.Building your Core Muscles
Strengthing your core muscles is one of the best things you can do for back pain. Your core muscles are what basically hold your entire body in the correct posture. Without the strength needed, you won’t be able to stand correctly and will have foot, knee, lower back, and shoulder pain. No one wants to have these problems plaguing him or her daily. Here are a few tips to really help you strengthen your core.
A great way to start is with an exercise ball. You can really build your muscles with some basic workout routines. You can really tone your core by sitting on the ball and lifting a small amount of weight over your head. Sitting on the ball causes you to constantly stabilize yourself. You can also do sit ups while on the ball. Simply lean back as far as possible and then proceed to slowly sit up. You will be working your core quite a bit doing this exercise. As your stength increases use the ball to do pushups by putting your feet on the ball. This is a challenge but your core will get an amazing workout. Those who find that too intense can check out pilates, tai chi, or yoga. All three of these are low impact but great for your core. All of these exercises focus on balance and correct posture. The longer you do them, the more your core will stengthen and the less back and joint aches you will suffer. There are a number of great dvds on all of these topics. I like Pilates for Beginners and Yoga for Beginners and Tai Chi for Health. These make great introductions to each exercise. Alought chiropractics can help relieve the pain, you can avoid this by dealing with your core muscles. Ultimately strengthening your core will never hurt your over all health, just be aware of your physical limitations and get working on that core.
